In case you forgot, in 2017 Michael Flynn took a deal and plead guilty to “willfully and knowingly” making false statements to the FBI. Earlier this year he moved to withdraw his guilty plea claiming there was a breach of the plea agreement ultimately resulting in a motion to drop all charges. Then the judge put a hold on the intent to drop charges.

Flynn is so close, he beat the system and was this close to being a free man. He had jumped through every hoop to prove his innocence, his included promoting some “Qanon” focused Twitter personalities who were already celebrating Flynn’s big contentious victory long before the dust had begun to settle.

So the Deep State isn’t ready to give up just yet.

A federal appeals court on Thursday tossed out its order that a trial court judge dismiss the criminal case against former Trump national security advisor Michael Flynn, and said it will rehear arguments on the issue.

The ruling is a blow to the retired Army lieutenant general and the Justice Department, which has asked the trial judge to drop the charge.

Flynn pleaded guilty in late 2017 to lying to FBI agents about his conversations with a Russian diplomat in the weeks before the inauguration of President Donald Trump.

But for more than a year, he has sought to undo the plea, and recently found support from top Justice Department officials.

Michael Flynn was one of the first original victims of the RussiaGate ploy that started in 2016. As a result, he had only been charged with process crimes
